Riverside

Homes, rentals, and long-held family property

Riverside has a mix of long-held family homes, rental properties, and newer neighborhoods. A home your parents bought decades ago, or a rental on the side, each raises its own planning questions.

A home worth about $650,000, close to a typical Riverside home value, would generate about $32,000 in statutory attorney and executor fees if it passed through probate, figured on the full value before any mortgage is subtracted. Probate here is heard at the Riverside Historic Courthouse downtown and typically takes 9 to 18 months.

A living trust avoids that process for every property it holds. Rental property can be held in the trust directly or through an LLC owned by the trust, and our guide on holding an LLC in your living trust explains when each makes sense.

Our office is in Corona, a short drive down the 91, and we handle the consultation and planning meetings remotely. Every plan is designed and drafted by a Montanez Yu attorney.

Common questions

Riverside estate planning questions

What does a plan cost?

Our flat fee for a complete plan starts at $2,500 for an individual and $3,000 for a married couple, quoted in writing before any work begins. The consultation is free. See what the flat fee covers.

We hold title in joint tenancy. Is that enough?

It avoids probate when the first owner dies, but not when the survivor dies, and for married couples it can cost a tax advantage. Our guide to joint tenancy and trusts explains why.

Do I have to drive to Corona?

No. We handle the consultation and planning meetings remotely, so you can work with us from home.

Should our rental go in the trust?

Usually, yes, or into an LLC that the trust owns. Either way, it avoids a separate probate for that property. We look at the mortgage, insurance, and liability exposure before recommending one.

Will my children keep my property tax base?

Only in limited cases. Under Proposition 19, a child keeps a parent’s property tax base on the family home only if the child moves in as their primary residence within a year, and only up to a value limit. Other property is reassessed. A rental does not qualify.

Do you speak Spanish?
