Car accidents

After a crash, the insurers move fast

Within days of a crash, adjusters are asking for statements, medical authorizations, and quick decisions, often before you know what to do after a car accident. Montanez Yu handles that contact for you. We gather the police report, photos, witness statements, and medical records, and identify every policy that may apply, including your own uninsured and underinsured motorist coverage.

We represent drivers, passengers, motorcyclists, pedestrians, and cyclists, including people hurt in crashes with commercial trucks and rideshare vehicles. We document your medical bills, lost income, and pain and suffering, then negotiate. If the insurers will not pay a fair amount, we are prepared to go to court.

After a crash

  • Get medical care, even if you feel fine

  • Photograph the vehicles, scene, and injuries

  • Exchange license and insurance information

  • Get witness names and phone numbers

  • File a DMV SR-1 within 10 days if required

  • No recorded statement before you talk to a lawyer

How we handle your claim

Four parts of a car accident claim

01

Liability

Who caused the crash. We use the police report, photos, vehicle damage, witness accounts, and, when available, video or vehicle data to show how it happened.

02

Insurance coverage

Which policies pay. That can include the other driver’s liability coverage, an employer’s commercial policy, and your own uninsured or underinsured motorist coverage.

03

Damages

What the crash cost you: medical treatment past and future, lost wages, vehicle damage, and the pain and disruption the injuries have caused.

04

Resolution

We present a documented demand and negotiate. If the insurer will not make a fair offer, we file suit and are prepared to take the case to trial.

Common questions

Car accident questions

What if I was partly at fault?

California follows comparative fault. Even if you were partly responsible for the crash, you can still recover damages, reduced by your share of the fault.

The other driver had no insurance. Now what?

Your own policy may include uninsured motorist coverage, which can pay what the at-fault driver’s insurance would have. These claims have their own requirements, so tell us about every policy in your household.

How long do I have?

Most car accident injury claims in California must be filed within two years of the crash. If a government vehicle or a dangerous public road was involved, a written claim is generally due within six months.

What does it cost?

The consultation is free, and there is nothing to pay up front. No fee and no costs unless we recover. Call (951) 444-7407 to talk with an attorney.
